Eligibility Criteria for the Subclass 491 Visa
The Skilled Work Regional (subclass 491) visa is a provisional, points-tested visa for skilled workers willing to live and work in regional Australia. Eligibility is set by the Department of Home Affairs, you must be invited to apply, be nominated by a state or territory or sponsored by an eligible relative, and meet the core criteria below.

ou can only apply for this visa if we invite you. Submit an Expression of Interest (EOI) in SkillSelect to register your interest, and indicate whether a state or territory government agency will nominate you or an eligible relative will sponsor you.
Be nominated or sponsored
You must be either nominated by an Australian state or territory government agency or sponsored by an eligible relative. Your EOI gives an indicative points score; if you score enough, state and territory agencies can see your EOI and may nominate you. If you indicate an eligible relative will sponsor you, the Department may invite you to apply in an invitation round.
Nomination by a state or territory government agency
If a state or territory nominates you, we will invite you to apply. Every agency sets its own state nomination Australia criteria, so contact the relevant one directly: the Australian Capital Territory, New South Wales, Northern Territory, Queensland, South Australia, Tasmania, Victoria or Western Australia.
Sponsorship by an eligible relative
Your family sponsor must be 18 or older, usually resident in a designated area of Australia, an Australian citizen, permanent resident or eligible New Zealand citizen, and your (or your partner’s) eligible relative. An eligible relative sponsor for a subclass 491 visa can be a:
- parent
- child or step-child
- brother, sister, or adoptive/step-sibling
- aunt, uncle, or adoptive/step-aunt or uncle
- nephew, niece, or adoptive/step-nephew or niece
- grandparent
- first cousin
We must approve the sponsorship before the visa can be granted.
Be under 45 at invitation
You must be aged under 45 to be invited to apply. You can still apply if you turn 45 after we invite you. If you turn 45 after submitting your EOI but before an invitation, you won’t receive an invite.
Have a suitable skills assessment
For a valid application, you must declare a suitable skills assessment at the time of invitation. Following the Thapa decision, an assessment obtained within the 60-day invitation period is accepted. Provide a copy with your application. It must have been obtained in the 3 years before your invitation date (or its shorter validity, if any). If your skills were assessed on an Australian qualification you earned on a student visa, that qualification must be from a CRICOS-registered course. For medical and legal practitioners we also accept full, unconditional or general, or conditional specialist, registration with AHPRA, or admission to practise law in the relevant state or territory.
Your occupation’s assessing authority is listed against it on the skilled occupation list. Common authorities include:
- ACS (Australian Computer Society): ICT occupations (around 4 to 6 weeks)
- Engineers Australia: engineering (around 6 to 12 weeks)
- VETASSESS: trades and vocational occupations (around 8 to 12 weeks)
- Trades Recognition Australia (TRA): trades (around 4 to 8 weeks)
- ANMAC: nursing and midwifery (around 4 to 8 weeks)
- CPA Australia: accounting (around 6 to 10 weeks)
Be able to score 65 points or more
The subclass 491 visa is points-tested. Your EOI gives an indicative score, and you need at least 65 points to be invited. Your invitation states the score you must reach when we assess your application (this may be higher than 65, depending on your EOI claims), and you must provide evidence for every claim. Have at least Competent English
At the time of invitation you must have at least Competent English (IELTS 6.0 in each band = 0 points). Higher levels earn points: Proficient (10 points) and Superior (20 points). Accepted tests are IELTS Academic, PTE Academic, the OET, TOEFL iBT and Cambridge C1 Advanced.
Family members aged 18 or older
If a family member aged 18 or older applies for the visa with you, they must either have functional English or pay a second-instalment visa application charge.
Meet the skills requirement
Your occupation must be on the combined list of eligible skilled occupations for the Skilled Work Regional (subclass 491) visa. Regional lists typically include more occupations than metropolitan lists.
Meet the health requirement
You and any family members who apply with you must meet our health requirement; family members not accompanying you may also need to if requested. In Australia, medical examinations are arranged through Bupa Medical Visa Services. Meet the character requirement
You and family members aged 16 or older who apply with you must meet the character requirement; family members not accompanying you must also meet it. This involves providing:
- AFP complete-disclosure National Police Check if you have spent 12 months or more in Australia in the last 10 years since turning 16 (state or standard certificates aren’t accepted).
- An overseas police certificate from every country where you spent 12 months or more in the last 10 years since turning 16.
- Completed Form 80 and Form 1221 declarations.
Repay any debt to the Australian Government
If you or any family members (including those not applying with you) owe the Australian Government money, it must be repaid or a repayment arrangement must be in place.

If you are 18 or older, you must have read (or had explained to you) the Life in Australia booklet and Australian Values Statement, and sign the statement confirming you will respect the Australian way of life and obey Australian laws.

Skilled Work Regional Provisional Visa Subclass 491 Application Process
The subclass 491 visa application follows the Department of Home Affairs’ official five steps, from your Expression of Interest to the visa decision. The same steps apply whether you take the state nomination or family sponsor pathway.
Step 1: Before you apply
Submit an Expression of Interest (EOI) through SkillSelect to tell the Department of Home Affairs you want to apply for this visa.

Step 1.1: Before you submit your EOI
Two invitation routes apply: if you score enough points, a state or territory government agency may nominate you; or if you nominated an eligible relative as a family sponsor, you may be invited in an invitation round.
- Check your occupation: must be on the combined list of eligible skilled occupations for the subclass 491 visa.
- Get your skills assessed: suitable skills assessment from the listed assessing authority, held at invitation (fees may apply). Obtained within 3 years before the invitation date (or its shorter validity); older ones aren’t accepted. Australian qualifications gained on a student visa must be from a CRICOS-registered course.
- Medical practitioners: AHPRA unconditional/general or conditional specialist registration, held at invitation.
- Barristers and solicitors: evidence of admission to practise law in an Australian state/territory, held at invitation.
- Check your points: score at least 65 points; below 65 you won’t be invited. All claims must be proven if invited. Use the points table (or the Skilled Migration Points Calculator) to estimate your score.
- Check you meet all other eligibility criteria: confirm all other 491 visa requirements.
Step 1.2: Submit an EOI
Lodge your EOI via SkillSelect from inside or outside Australia. There is no fee, and it is not a visa application. Select the Skilled Work Regional (Provisional) visa (subclass 491) Invited pathway, indicate your preferred states and/or confirm your family sponsor, then submit. You’ll receive a confirmation email.
Step 1.3: After you submit your EOI
SkillSelect estimates your score; you need at least 65 points and places allocated for your occupation to be invited.
- Nomination: if you seek state nomination, your EOI is visible to state and territory agencies who may nominate you. If nominated, you and all family unit members who hold the visa must live, work and study only in certain designated regional areas.
- Sponsorship: if you nominated an eligible relative to sponsor you, you may be invited to apply. The same designated-regional-area obligation applies.
- Stay lawful: an EOI grants no bridging visa; you are only eligible for a bridging visa after you are invited and apply. If your current visa is about to expire, apply for another visa to remain lawful.
- Make changes to your EOI: update SkillSelect if you want a different skilled visa, your circumstances or family change, you can claim more points, or your employment changes and you are no longer working at least 20 hours per week in your nominated occupation. Editable any time before invitation; you must still meet the invited points score.
Step 1.4: Receive an invitation to apply for visa
Places are allocated to meet the Australian Government’s migration planning levels.
- 60 calendar days to apply: this cannot be extended.
- Invitations can arrive up to 2 years after your EOI, by email from SkillSelect; an invitation is not a grant.
- You must meet the indicative points score on your invitation and all other eligibility criteria.
- You can only be invited twice: if you don’t apply after the second invitation, your EOI is removed.
- Not processed if you are 45 or over at the time of invitation.
- If you can’t meet the score or criteria: don’t apply. Your EOI is suspended once an invitation is issued but can be updated after the 60-day period; if it was your second invitation, submit a new EOI.
- Get help with your application: only a registered migration agent, legal practitioner or exempt person can give immigration assistance. You can appoint anyone to receive documents on your behalf.
Step 2: Gather your documents
Provide documents supporting your EOI claims and showing you meet the other visa criteria: the subclass 491 visa document checklist.
Provide accurate information
Give true, accurate information; there are consequences if you can’t prove your identity or provide false details.
Identity documents
- Passport pages showing your photo, personal details and issue/expiry dates.
- National identity card, if held.
- Proof of any name change: marriage/divorce certificate, official change-of-name records, or evidence of other names used.
Relationship documents
- If married, widowed, divorced or permanently separated, provide proof (divorce documents, death certificates, separation documents or statutory declarations).
- Explain any partner or child not included in the application.
Character documents
- AFP complete-disclosure National Police Certificate if 12+ months total in Australia in the last 10 years since 16 (state/standard certificates not accepted; valid 12 months).
- Overseas police certificate from every country with 12+ months in the last 10 years since 16.
- Military service or discharge papers if you served.
- Complete Form 80 and Form 1221.
Competent English documents
Proof of at least competent English at the time of invitation.
Partner documents
- Partner’s identity documents and photos, character documents, marriage certificate and other-relationship documents if applicable.
- De facto: state/territory registration, or proof of a de facto relationship for at least 12 months before applying.
- All couples: proof of a genuine and continuing relationship (joint accounts, bills in joint names, joint lease/mortgage, shared address).
- Functional English: your partner must prove at least functional English. If any dependent applicant who did not pay the second instalment can’t show functional English, you’ll pay the second instalment of the visa application charge for each of them when asked.
Dependants under 18 documents
- Birth certificates or family book naming both parents; adoption papers if applicable.
- Parental responsibility: consent (Form 1229 or statutory declaration) from anyone with a legal right to decide where the child lives who isn’t migrating, or an Australian court order / home-country law permitting migration. Include the signatory’s photo ID and any adoption/court documents.
- No functional English needed. A child turning 18 during processing must show dependency; if not dependent, they can’t satisfy the criteria.
Dependants over 18 documents
- Must be under 23 and dependent on you or your partner, or 23+ and unable to support themselves due to physical/cognitive limitations and dependent.
- Provide identity and other-relationship documents, proof of relationship (birth or adoption records), Form 47a, and proof of financial dependency.
- If 23+ (or turning 23 during processing), add a qualified medical practitioner’s report confirming dependency due to loss of bodily or mental function. A child turning 23 during processing without meeting this can’t satisfy the criteria.
- Functional English: all dependants aged 18+ must prove functional English, or the second instalment applies for each who can’t.
Skills assessment documents
- Documents for every EOI claim (use the points table): skills assessment, English, Australian/overseas employment, qualifications, Australian study requirement, specialist education, community language, regional study, partner skills, Professional Year.
- Following Thapa, a suitable skills assessment obtained within the 60-day invitation period is accepted.
- Medical practitioners: AHPRA registration, held at invitation.
- Barristers and solicitors: Admission or Practising Certificate, held at invitation.
Expression of Interest (EOI) documents
Documents proving all claims made in your EOI (use the points table).
Employment documents
- Evidence of each claimed period, dated before invitation: references, contracts, payslips, tax statements, group certificates or payment summaries, superannuation.
- References must be on official letterhead with a street address (not a PO Box), phone/email/website; state exact period, each position, permanent/temporary, full/part-time, main duties and salary; and give the signatory’s typed name, position and direct number.
- References with only an illegible signature aren’t accepted.
Sponsor documents (family-sponsored pathway)
If you are being sponsored for subclass 491 visa, provide:
- Skilled Work Regional (Class PS) 491 Sponsor Declaration completed by your sponsor.
- Proof your sponsor is an eligible relative, has turned 18, and is an Australian citizen, permanent resident or eligible New Zealand citizen (citizenship certificate or passport bio-data page).
- Proof your sponsor usually resides in a designated regional area (driver’s licence, mortgage/tenancy agreement, utility bills).
- Proof of the sponsor’s relationship to you (birth, marriage, death or adoption certificates, or officially issued family status certificates/family books).
Nomination documents (state-nominated pathway)
If you are being nominated, you do not need to provide evidence of the nomination with your application.

Prepare your documents
- Translate: all non-English documents translated (original + translation). Translators in Australia must be NAATI-accredited (National Accreditation Authority for Translators and Interpreters); overseas translators must list their full name, address, phone, and qualifications and experience in the language, in English. No certification needed.
- Scan or photograph: clear colour copies of all documents; save any multi-page document as one file.
Step 3: Apply for the visa
Once invited, apply online within 60 days of your invitation date, from inside or outside Australia.
Provide accurate information
Consequences apply for false details or an unproven identity.

- Log in to or create an ImmiAccount: your ImmiAccount login and password are not the same as your SkillSelect login.
- Attach your documents.
- Pay the first visa application charge (the 491 visa cost); your application won’t be processed until this first instalment is paid.
- Note your transaction reference number (TRN).
- Each family member must have their application charge paid and documents attached to their application.
Step 4: After you apply
The Department confirms when your application is received and notifies you of any bridging visa grant.
- Status updates: none within the standard 491 visa processing time; check ImmiAccount if information is needed.
- Travel after you apply, in Australia: no need to notify (a decision can be made while you’re offshore), but ensure your visa allows return (check VEVO). Offshore applicants: don’t travel to Australia, quit a job or sell a home until granted in writing.
- Health exams: if not done earlier, the Department advises via ImmiAccount if needed.
- Biometrics: may be requested (fingerprints and photo).
- Attach more information: upload outstanding documents promptly; the Department may request more but can decide without asking.
- Stay lawful: if in Australia, your Bridging Visa A (BVA), granted at lodgement, takes effect if your current visa expires before a decision. Don’t cancel your current visa, it ends the BVA and leaves you unlawful.
- Pay the second instalment: when the Department sends the invoice.
- Add family: you can add dependent children before a decision via Form 1436 (pay and attach in ImmiAccount). Applicants must meet health and character requirements; non-migrating members must meet character (and possibly health).
- Newborn child: notify the Department as soon as possible if a child is born after you apply but before a decision.
- Subsequent entrants: if granted, family members may apply to join you in Australia later as subsequent entrants.
- Mistakes on your application: report promptly via Form 1023 in ImmiAccount.
- Help with your application: withdraw an authorised recipient (Form 956A) or agent (Form 956) via ImmiAccount.
- Tell us if things change: phone, email, address, passport, marital/de facto status, a birth, or withdrawal.
Step 5: Visa outcome
Decided in writing; you can be inside or outside Australia (but not in immigration clearance).
- If granted: you’ll get your visa grant number, start date and any conditions (keep a copy). We digitally link your visa to your passport; you will not get a label.
- If refused: you’ll be told the reason and any review rights; the application charge isn’t refunded.
When You Have the Subclass 491 Visa
Coming to Australia
- Enter Australia before the ‘must not arrive after’ date shown on your visa.
- Digital visa label: we digitally link your visa to your passport; you will not receive a physical label. Keep your grant notice, which sets out your conditions.
- Proof of status: if you need to show your immigration status (for example, to an employer), use VEVO or request an Immigration Status Document (ISD).
- SmartGate: eligible travellers can use SmartGate for faster processing on arrival.
In Australia
- Live, work and study only in a designated regional area for the full 5 years (condition 8578); everywhere except Greater Sydney, Melbourne and Brisbane qualifies as regional.
- Check your visa details and conditions anytime through VEVO.
- Workplace rights: everyone working in Australia has basic workplace rights and protections, including minimum pay and conditions.
- Health cover: Australia has reciprocal health care agreements with some countries that may give you access to essential medical care.

- Staying longer: after 3 years of regional residence meeting the requirements, you may be eligible for the Subclass 191 permanent visa (your main subclass 491 visa pathway to permanent residency).
Important: New Zealand passport holders
If an immigration officer processes your clearance at the border, we recommend you tell them:
- you have a Skilled Work Regional (Provisional) visa (subclass 491)
- you do not want a Special Category visa (subclass 444)
If you do not tell them, you might be granted the subclass 444 visa. Grant of a subclass 444 visa might affect your eligibility for permanent residency through a Permanent Residence (Skilled Regional) visa (subclass 191) and, ultimately, your eligibility for permanent residency or Australian citizenship.
You cannot apply for other permanent visas yet
Unless you have held your subclass 491 visa for 3 years, you cannot:
- make a valid application for a Subclass 820 (Partner) visa; or
- be granted a Subclass 132, 186, 188, 189, 190 or 858 visa.
For the first 3 years, your only permanent residency pathway is the Subclass 191.
Leaving Australia
- You can leave and re-enter while the visa is valid: check your visa allows return via VEVO before you travel.
- SmartGate: eligible travellers can use SmartGate on departure.
- Movement records: you can request your Australian travel and movement records if you need proof of your travel history.
- Superannuation: if you worked in Australia you likely have money in a super fund if you are 18 or older and were paid AUD450 or more before tax in a month. When you leave Australia permanently, you may be able to claim it as a Departing Australia Superannuation Payment (DASP).

What are the 491 visa conditions?
The 491 visa condition requirements include:

Yes, the 491 visa is not tied to a specific employer. You can change employers, become self-employed, or study any course, as long as you continue to live, work and study in your nominating regional area.
Can 491 holders apply for 189?
Yes, 491 holders can lodge an EOI for the 189. However, you cannot be granted a 189 (or 190, 186, 132, 188 or 858) visa until you have held the 491 for 3 years. During the first 3 years, your only permanent residency pathway is the Subclass 191.
