  • Be in a genuine relationship with your spouse or de facto partner in Australia.
  • Be living outside Australia while applying.

Your partner must be a permanent resident of Australia, an Australian citizen or an eligible citizen of New Zealand.

Cost

This visa costs around AUD 7,850. This fee includes both the temporary and permanent Partner visa Australia.

A fee is also charged for each family member who applies for the visa with you. However, if your family member holds a Dependent Child visa (subclass 445) so, there’ll be no fee for them.

Stay Period

You can stay in Australia temporarily until your application for a permanent Partner Visa Australia (subclass 100) gets approved.

Partner Visa 801 – Permanent Residency

Subclass 801 partner visa allows the de facto partner or spouse of an Australian permanent resident, an Australian citizen or an eligible citizen of New Zeeland to stay in Australia permanently. This visa is only available to those who currently hold a temporary Partner visa 820.

Processing Time

  • 75% of applications take 9 months to process.
  • 90% of applications get finalized within 14 months.

Attach complete documents with your application for a permanent Partner Visa  801. As DOHA might delay the processing time in case of incomplete documents.

Eligibility

If you would like to apply for the permanent partner visa 801, you must;

  • Have a temporary Visa subclass 820.
  • Must be married or in a genuine relationship with your spouse or de facto partner in Australia.

Your partner must be a permanent resident of Australia, an Australian citizen or an eligible citizen of New Zealand.

Cost

Combined applications for temporary and permanent partner visas include the subclass 801 fee.

Partner Visa 100 are for spouses or de facto partners of Australian citizens, Australian permanent residents, and eligible citizens of New Zealand who wish to reside permanently in Australia. This visa is offered to people who hold a temporary Partner Visa  309.

  • 75% of applications take 19 months to be processed.
  • 90% of applications take 27 months to be processed.

Eligibility

To be eligible for the Partner Visa 100, you must;

  • Have a temporary Partner visa 309.
  • Stay married or in a de facto relationship with the person who sponsored you.
  • Make sure you’ve paid your debts to the Australian Government.

  • It allows you to live, study, and work permanently in Australia.
  • Your family members can travel to Australia by your sponsorship.
  • You can apply for Australian citizenship if you’re eligible.
  • You’re allowed to travel from and to Australia for 5 years.

What is de facto Partner?

A de facto partner is someone you’re in a relationship with but not married. In a de facto relationship, you and your partner live together as a couple. However, you both aren’t married.

Can a Permanent Partner Visa be cancelled in Australia?

Yes, a permanent partner visa can be canceled. If you provide misleading information or false documents. The Department of Home Affairs will refuse your visa application if you don’t meet the visa conditions for a permanent Partner Visa.

How to Withdraw Partner Visa Application?

You can withdraw your Partner Visa application if you’ve applied online. You’ve to do this before the Department of Home Affairs makes a decision on your application.

To withdraw your visa application, you need to:

  • Login to your ImmiAccount.
  • Select on “View” to open your application
  • Choose “Update details
  • Select “withdrawal of a visa application

If you can’t find a link to withdraw your application, fill out the Form 1446 Withdrawal of a visa application (338KB PDF).  You must attach this form to your visa application. While if you applied on paper, you could send the completed form to the place where your application is being processed.

How to cancel a Partner Visa as a Sponsor?

The sponsor can withdraw the application by writing a letter to the Department of Home Affairs. This letter includes:

  • Your date of birth and full name
  • Transaction Reference Number (TRN)/File Reference Number (FRN) for visa application
  • A statement showing that you withdraw your sponsorship from the Partner Visa application

You can email this letter to where the application is being processed. Partner Visa application will not withdraw just by removing it from ImmiAccount. You must inform Home Affairs via a letter that you don’t want to sponsor your spouse/partner.
