November updates for Australian Immigration: Subclass 191 Visa Updates

 

People with a Subclass 191 Visa are allowed to live and work permanently in Australia if they have resided and worked in designated regional areas. This visa subclass will officially commence on 16 November 2022.

According to the November updates for Australian immigration, the new legislative regulations enable family members of the holder of a Permanent Residence of Skilled Regional visa to join a Subclass 191 visa application without having to leave Australia.

 

For the primary applicant to be eligible for a subclass 191 visa, they must

  • Hold a “pathway” visa for example a subclass 491 or a subclass 494.
  • They must also meet the condition of residing for at least three years in a regional area of Australia.

 

Family members and dependents, who may currently hold another visa with a No Further Stay condition, are exempt from these conditions. The update modifies allowing the No Further Stay condition to be removed and allowing relevant additional applicants to be added to the onshore application of the primary applicant.

The start date for this update is November 12, 2022.

 

November updates for Australian Immigration: Migration Queensland BIIP suspended

 

Migration Queensland assists immigrants by giving them the chance to experience working, living, and playing in their wonderful state. Migration Queensland is the Queensland State Government’s office in charge of business and skilled visa nomination.

 

Due to the completion of Migration Queensland’s interim allocation for company nominations, Queensland’s business nomination program (BIIP) is temporarily paused since November 8, 2022. Currently only submitted nomination applications are being handled and are given priority.

November updates for Australian Immigration: Subclass 408 – COVID-19 Updates

 

The November Updates for Australian immigration provide updates and clarification of conditions on Subclass 408 visas in the Pandemic stream.

The major updates to be noted are as follows:

 

  • Due to a lack of skilled workers and labor, Australia has a less severe policy on visa condition 8107, which permits these visa holders to work without restriction.

 

  • It is possible for visa applicants and holders to switch jobs and work for multiple employers. It is not necessary to inform the Department of changes in employment.

 

  • Holders with SC 408 visas who are employed in Australia may continue to work. They need to find new jobs if they are unemployed or leave Australia if they are no longer employed.

 

  • It is important to note that since this is a substantive visa and not a bridging visa, subclass 408 visa holders who previously held substantive visas with visa condition 8101 will not be able to carry over that visa condition to their 408 visas.
